Introduction
BallCapBuddy(“the Company,” “we,” “us,” or “our”) operates the website located at ballcapbuddy.com(the “Site”) and sells cap preservation products through that Site and through authorised reseller channels.
These Consumer Terms & Policies (collectively, the “Terms”) constitute a legally binding agreement between you (“you,” “your,” or “Customer”) and the Company governing your access to and use of the Site and any purchase of our products.
These Terms incorporate by reference our Privacy Policy (§ 10), our Return & Refund Policy (§ 7), our Shipping Policy (§ 6), and our Product Warranty(§ 8). Where these documents conflict, the more specific provision prevails.
Acceptance of Terms
By accessing or using the Site, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms and any policies incorporated herein.
If you do not agree to these Terms in their entirety, you must immediately cease using the Site and must not place any orders.
Age requirement
You must be at least 18 years of age, or the age of majority in your jurisdiction if higher, to use the Site or place an order. By using the Site you represent and warrant that you meet this requirement. If you are under 18, you may only use the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.
Business customers
If you are purchasing on behalf of a legal entity, you represent that you have authority to bind that entity to these Terms, in which case “you” refers to that entity.
Products & Services
BallCapBuddysells cap preservation devices and related accessories (collectively, “Products”). All Products are subject to availability. We reserve the right at any time to modify, discontinue, or limit the quantity of any Product without notice.
Product descriptions
We strive to provide accurate descriptions, images, and specifications on the Site. However, colours displayed on screen may differ from actual Productsdepending on your device display calibration. Minor dimensional tolerances are inherent in manufacturing. Such variations do not constitute defects or grounds for return beyond the statutory or voluntary return rights set out in § 7.
Right to refuse orders
We reserve the right, in our sole discretion, to refuse, limit, or cancel any order for reasons including, without limitation: suspected fraud, payment failure, stock unavailability, pricing errors, or suspicion that Products will be resold in violation of applicable law or these Terms. Where an order is cancelled after payment, a full refund will be issued within 14 days.
Product availability
Availability displayed on the Site is indicative only. Simultaneous orders may exceed available stock. In the event your ordered Product becomes unavailable after order confirmation, you will be notified promptly and offered either a full refund or, where available, an equivalent substitute at no additional cost.
Orders & Payment
Order process
Placing an order on the Site constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation email. We reserve the right to decline any order for the reasons set out in § 3.
Payment processing
All payments are processed through Stripe, a PCI-DSS Level 1 compliant payment processor. By placing an order you agree to Stripe’s applicable consumer terms. We do not receive, store, or process any payment card data on our servers. All such data is handled exclusively by Stripe under their own security protocols.
Accepted payment methods
Accepted payment methods are those made available through Stripe at the time of purchase (including major debit/credit cards and eligible digital wallets). Available methods may vary by country and are displayed at checkout.
Currency & charges
Prices are displayed in Euros (EUR). For purchases made in other currencies, your card issuer may apply a foreign exchange conversion fee for which we are not responsible.
Order records
You are responsible for retaining a copy of your order confirmation. We may store order records electronically for the period required by applicable law (see § 10).
Pricing & Promotions
All prices displayed on the Site are in Euros and are inclusive of applicable VATunless explicitly stated otherwise. VAT is applied in accordance with EU rules based on the delivery country.
Pricing errors
We take reasonable care to ensure pricing accuracy. If a pricing error is discovered after your order is placed, we will notify you and offer you the choice of purchasing the Product at the correct price or cancelling the order for a full refund. We are under no obligation to honour an erroneously priced order.
Promotions & discounts
Promotional offers, discount codes, and bundle pricing are offered at our sole discretion and may be withdrawn at any time. Promotions cannot be combined unless expressly stated. Promotional codes have no cash value, are non-transferable, and are valid only for the period and conditions specified. Expired or invalid codes will not be applied.
Price changes
We reserve the right to change our prices at any time. Price changes will not affect orders for which an order confirmation email has already been sent.
Shipping & Delivery
Shipping zones
BallCapBuddy currently ships to countries within the European Union and selected European territories. Available shipping destinations are displayed at checkout and are subject to change.
Delivery timeframes
Estimated delivery timeframes are communicated at checkout and in your order confirmation. These are estimates onlyand not guaranteed dates. Delivery times may be affected by carrier capacity, customs processing, national holidays, or force majeure events (§ 16). We are not liable for delays caused by factors outside our control.
Risk of loss
Risk of loss and title for Products pass to you upon delivery to your designated address. For EU consumers exercising the right of withdrawal, risk passes back to us upon your handing of the Product to the return carrier, provided our return process is followed.
Accurate delivery information
You are solely responsible for providing a complete and accurate delivery address at the time of order. BallCapBuddyis not responsible for delays or non-delivery caused by inaccurate or incomplete address information. Reshipping costs arising from address errors are the Customer’s responsibility.
Lost or damaged shipments
If your shipment is lost or arrives damaged, please contact us at legal@ballcapbuddy.com within 14 days of the expected delivery date. We will investigate with the carrier and, where liability is confirmed, arrange replacement or refund at our discretion.
Returns & Refunds
Our 30-day return policy
In addition to your statutory rights, BallCapBuddy offers a 30-day return windowfrom the date of delivery. To be eligible under our voluntary policy, the Product must be:
- Unused and in its original, unaltered condition;
- In original packaging with all included accessories and documentation;
- Free from damage caused by misuse, modification, or accidents;
- Accompanied by proof of purchase (order confirmation email).
Return process
To initiate a return, contact us at legal@ballcapbuddy.com with your order number and reason for return. We will provide a return merchandise authorisation (RMA) number and return shipping instructions. Returns sent without an RMA number may be refused.
Return shipping costs
For returns under the EU statutory withdrawal right, we will refund the original outbound shipping cost (standard rate). Return shipping is at your cost unless the Product is defective, damaged in transit, or incorrect. We recommend using a tracked shipping service; we are not responsible for returns lost in transit.
Refund processing
Upon receipt and inspection of a returned Product, we will process your refund within 14 days. Refunds are credited to the original payment method. Processing times by your bank or card issuer may add 3–5 business days.
Defective or incorrect products
If you receive a defective, damaged, or incorrect Product, you are entitled to a remedy under EU consumer law regardless of return timing. Contact us immediately; we will arrange a free return and either replacement or full refund at your choice.
Product Warranty
Limited lifetime warranty
BallCapBuddy warrants to the original purchaser that the Product is free from manufacturing defects in materials and workmanshipfor the lifetime of the Product under normal use (“Limited Warranty”).
What is covered
- Structural failure of the product frame under normal use;
- Defects in materials that cause functional failure;
- Workmanship defects present at the time of purchase.
What is not covered
- Damage caused by misuse, abuse, accident, or modification;
- Normal wear and discolouration from prolonged use;
- Damage caused by use with a washing machine programme or temperature beyond recommended limits;
- Cosmetic damage that does not affect function;
- Products purchased through unauthorised resellers;
- Products with altered, removed, or illegible serial numbers or labels;
- Damage caused by exposure to chemicals, solvents, or improper cleaning agents.
Warranty claims
To make a warranty claim, contact legal@ballcapbuddy.com with your order number, a description of the defect, and photographs. We reserve the right to inspect the Product before determining a remedy. Our sole obligation under this warranty is, at our discretion, to repair, replace, or refund the affected Product.
Statutory rights unaffected
This Limited Warranty does not affect your statutory rights under EU law (including the two-year legal guarantee under Directive 1999/44/EC and its successor Directive 2019/771/EU), which apply in addition to this warranty.
Intellectual Property
The Site and all of its content, including without limitation text, graphics, logos, product designs, button icons, images, audio clips, digital downloads, data compilations, and software, are the exclusive property of BallCapBuddy or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, trade dress, patent, and trade secret laws.
Trademarks
BALLCAPBUDDY, the BallCapBuddy logo, and all related product names, slogans, and trade dress are trademarks or registered trademarks of the Company. You may not use any of our marks without our prior written consent.
Limited personal use licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site solely for your personal, non-commercial purposes. This licence does not include the right to:
- Reproduce, distribute, or publicly display any Site content;
- Create derivative works based on any Site content;
- Use data mining, robots, or similar data gathering tools;
- Use the Site or Products for any commercial purpose without our written consent;
- Frame or mirror the Site without written authorisation.
User-submitted content
If you submit reviews, photos, videos, or other content to us or tag us on social media, you grant BallCapBuddy a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, modify, publish, and distribute that content for marketing and promotional purposes. You warrant that you own or have the right to grant this licence.
Privacy & Data Protection
BallCapBuddy is committed to protecting your personal data in compliance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and applicable national implementing legislation.
Data we collect
- Identity & contact data: name, email address, phone number;
- Delivery data: shipping address;
- Transaction data: order details, product purchased, amount paid;
- Technical data: IP address, browser type, referring URL, session data (collected via Convex);
- Analytics data: aggregate, anonymised page-view and event data (Vercel Analytics).
We do not collect or store payment card data — this is handled exclusively by Stripe under their PCI-DSS compliant infrastructure.
Legal basis for processing
- Contract performance (Art. 6(1)(b) GDPR): Processing your order, arranging delivery, issuing refunds;
- Legal obligation (Art. 6(1)(c) GDPR): Retaining transaction records for tax and accounting purposes;
- Legitimate interests (Art. 6(1)(f) GDPR): Fraud prevention, site security, anonymised analytics to improve the Site;
- Consent (Art. 6(1)(a) GDPR): Marketing communications, where you have opted in.
Third-party processors
- Stripe, Inc.: Payment processing; subject to Stripe’s own privacy policy;
- Convex, Inc.: Backend data infrastructure and session management;
- Vercel, Inc.: Hosting and anonymised analytics.
We enter into data processing agreements with all processors and require them to process data only on our documented instructions and in compliance with the GDPR.
Data retention
Order and transaction records are retained for 7 years from the date of purchase to comply with Dutch bookkeeping requirements. Session and analytics data is retained for no more than 90 days. Marketing consent records are retained until you withdraw consent.
Your rights
Under the GDPR you have the right to:
- Access the personal data we hold about you;
- Rectify inaccurate data;
- Erasure of your data (“right to be forgotten”), subject to legal retention requirements;
- Restriction of processing in certain circumstances;
- Data portability;
- Object to processing based on legitimate interests;
- Withdraw consent at any time (without affecting the lawfulness of prior processing).
To exercise any of these rights, contact legal@ballcapbuddy.com. We will respond within 30 days. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, autoriteitpersoonsgegevens.nl).
Cookies
We use strictly necessary cookies to maintain your session and shopping cart. No third-party advertising or tracking cookies are set. Our anonymised analytics do not use cookies that identify individual users.
Prohibited Conduct
You agree not to, and will not permit others to:
- Place fraudulent orders or provide false information;
- Circumvent, disable, or otherwise interfere with security features of the Site;
- Use automated tools (bots, scrapers, crawlers) to access the Site without our written permission;
- Attempt to gain unauthorised access to any part of the Site or its related systems;
- Transmit any malicious code, viruses, or harmful data;
- Impersonate any person or entity or misrepresent your affiliation;
- Use the Site in any manner that could damage, disable, overburden, or impair the Site;
- Purchase Products for the purpose of resale without our written authorisation (see the Reseller Agreement);
- Use the Site for any unlawful purpose or in violation of applicable laws;
- Harvest or collect personal information about other users;
- Post, upload, or transmit content that is defamatory, obscene, or infringes any third-party right.
Violation of this section may result in immediate termination of your access to the Site and, where applicable, referral to law enforcement authorities.
Third-Party Services
The Site integrates with third-party services including Stripe (payments), Convex (infrastructure), and Vercel Analytics. These services are governed by their own terms and privacy policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
Links from our Site to external websites are provided for convenience only. We do not endorse, control, or assume responsibility for the content or practices of any linked third-party websites. Visiting linked sites is at your own risk.
Temporary unavailability of a third-party payment or infrastructure service may cause interruption to the Site. We will not be liable for losses arising from such interruption provided we take reasonable steps to restore service.
Disclaimers
We do not warrant that:
- The Site will be uninterrupted, error-free, or free from viruses or harmful components;
- Results obtained from using the Site will be accurate or reliable;
- Any defects in the Site will be corrected;
- Products will meet every individual use case beyond their stated intended purpose.
Product descriptions and marketing materials reflect general intended use. Individual results may vary based on cap type, washing conditions, and usage patterns. Claims in marketing materials constitute opinions and general guidance, not guarantees.
Limitation of Liability
In all cases, our aggregate liability to you for any claim arising under or in connection with these Terms or any purchase shall not exceed the total amount you paid to us in the 12-month period preceding the claim.
Preservation of mandatory consumer rights
Nothing in this section limits our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be excluded or limited under applicable EU or Dutch law;
- Product liability under applicable product safety laws.
Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless BallCapBuddy and its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to:
- Your violation of these Terms;
- Your use or misuse of the Site or Products;
- Your violation of any applicable law or third-party right;
- Any content you submit, post, or transmit through the Site;
- Fraudulent activity conducted through your account or using your payment credentials.
This indemnification obligation does not apply to the extent a claim arises from our own negligence, wilful misconduct, or breach of these Terms.
Force Majeure
BallCapBuddy shall not be liable for any delay or failure to perform its obligations under these Terms to the extent such delay or failure is caused by circumstances beyond our reasonable control, including without limitation:
- Natural disasters, floods, earthquakes, or extreme weather events;
- Acts of war, terrorism, civil unrest, or government action;
- Pandemic, epidemic, or public health emergency;
- Strikes or industrial action affecting our supply chain or logistics partners;
- Interruption or failure of utility services, telecommunications, or the internet;
- Supply chain disruptions affecting the availability of materials or Products.
In such circumstances, we will notify you as soon as reasonably practicable and make reasonable efforts to mitigate the impact. If the force majeure event continues for more than 30 days, either party may cancel any affected order for a full refund.
Modifications to Terms
We reserve the right to modify, update, or replace any part of these Terms at any time in our sole discretion. When we make material changes, we will:
- Update the “Last Updated” date at the top of this page;
- Notify registered customers by email at least 14 days before the changes take effect, where practical;
- Prominently display a notice on the Site.
Your continued use of the Site or placement of an order after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must cease using the Site. Changes will not retroactively affect orders placed and confirmed before the effective date.
General Provisions
Severability
If any provision of these Terms is found by a court or arbitrator to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
No waiver
Our failure to enforce any provision of these Terms at any time shall not be construed as a current or future waiver of that provision, nor shall it affect our right to enforce that provision at a later time.
Entire agreement
These Terms, together with any policies incorporated by reference and any specific terms communicated at point of sale, constitute the entire agreement between you and BallCapBuddywith respect to the subject matter hereof and supersede all prior or contemporaneous communications and proposals, whether oral or written.
Assignment
We may assign these Terms or any of our rights or obligations hereunder without your consent, provided that such assignment does not materially diminish your rights. You may not assign these Terms or any rights hereunder without our prior written consent.
No third-party beneficiaries
These Terms do not confer any rights or remedies on any third party unless expressly stated.
Governing Law & Disputes
Governing law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law principles. For EU consumers, this choice of law does not deprive you of the protection afforded by mandatory provisions of the law of your country of residence.
Jurisdiction
Any dispute that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands, unless mandatory local law in your country of residence requires otherwise.
EU Online Dispute Resolution
As an EU consumer, you have the option to use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes. Our contact email for ODR purposes is legal@ballcapbuddy.com.
Informal resolution
Before filing any formal claim, you agree to contact us at legal@ballcapbuddy.com and attempt in good faith to resolve the dispute informally. We will do the same. Informal resolution must be attempted for at least 30 days before initiating formal proceedings, unless emergency relief is required.
